IMPORTANT: PLEASE READ THESE OFFICIAL RULES CAREFULLY BEFORE ENTERING STORM8’S BINGO JANUARY 2017 SWEEPSTAKES (THE “SWEEPSTAKES”). BY ENTERING THE SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND REPRESENT THAT YOU SATISFY ALL OF THE ELIGIBILITY REQUIREMENTS IN PARAGRAPH 1 BELOW.

NO PURCHASE NECESSARY TO ENTER OR WIN; PURCHASE WILL NOT INCREASE ODDS OF WINNING.

STORM8 IS SPONSORING THIS SWEEPSTAKES AND THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY OR AFFILIATED WITH ANY OTHER ENTITY.

1. Eligibility. THE SWEEPSTAKES IS ONLY OPEN TO LEGAL RESIDENTS OF THE UNITED STATES, INCLUDING THE DISTRICT OF COLUMBIA (BUT EXCLUDING NEW YORK, FLORIDA, RHODE ISLAND, PUERTO RICO AND OTHER U.S. TERRITORIES AND POSSESSIONS) WHO ARE 18 YEARS OLD AND HAVE REACHED THE AGE OF MAJORITY IN THEIR STATE BY THEIR DATE OF ENTRY. IF YOU ARE NOT A LEGAL RESIDENT OF THESE AREAS, YOU ARE NOT ELIGIBLE TO WIN A PRIZE. Directors, officers and employees of Storm8, Inc. (“Company” or the “Provider”), and any of its respective parents, affiliate companies, subsidiaries, agents, professional advisors, advertising, promotional, Web design and hosting agencies (collectively, the “Participating Entities”), immediate families of such persons, and any other persons connected with the production or distribution of this Sweepstakes, are not eligible to win any prizes.

To be eligible to win a prize, entries must be completed and received by the Provider in the format designated in paragraph 3 below. The Provider reserves the right to disqualify any entry from the Sweepstakes if, in the sole judgment of Provider, the entrant submitting such entry is not eligible or has not complied with these Official Rules. Without limitation of the foregoing, all of an entrant’s entries will be disqualified, at the sole discretion of the Provider, if entrant attempts (a) to participate in or enter the Sweepstakes through any means other than as described in these Official Rules, (b) provides information that is inaccurate or fraudulent, or (c) attempts to disrupt the Sweepstakes or circumvent these Official Rules.

ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. SWEEPSTAKES VOID WHERE PROHIBITED.

2. Sweepstakes Period. The Sweepstakes period is from 12:01 p.m. (all times Pacific Time) on January 6th, 2017 to 12:00 p.m. on January 10th, 2017 (the “Sweepstakes Period”). All electronic entries must be received by Provider during the Sweepstakes Period to be eligible to win a prize. All mail-in entries must be postmarked during the Sweepstakes Period, and must be received by Provider no later than 10:00 a.m. on January 26th, 2017 to be eligible to win a prize.

3. How to Enter. There are two ways to enter.

(A) You may obtain one (1) entry during the Sweepstakes Period for each dollar spent in game for premium currency during the Sweepstakes period up to a maximum of sixty (60) entries.

(B) You may also obtain one (1) entry into the Sweepstakes without a purchase by writing your name, Storm8 ID, and address on a 3×5 postcard and mailing it to Storm8, Inc., 1000 Bridge Parkway, Redwood City, CA 94065 Attn: BINGO JANUARY 2017 Sweepstakes. All entries must be postmarked and received, as applicable, during the applicable period set forth in Paragraph 2 above in order to be eligible to win a prize. Limit of one (1) entry per postcard up to a maximum of sixty (60) entries.

Printed, stamped or machine-written entries are not valid. The prize winner address cannot be a P.O. Box. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Provider.

4. Prize.

• Ten (10) Grand Prizes: 1,000 Gems, 4000 Coins, and 45 Tickets – Approximate retail value (“ARV”): of each prize is $50.00 and the total ARV is $500.00.

Odds of winning a prize depend on number of eligible entries received. ARV may not reflect local or resale value. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. A Form No. 1099 may be issued to all winners for the value(s) of such winner’s prize(s) for the year 2017.

Title and risk of loss to the prize shall pass to winners upon Provider’s delivery of the prize to a common carrier. Prizes returned as undeliverable or otherwise not claimed within ten (10) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Provider reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address.

Actual appearance and features of the Grand Prize shall be selected by Provider in its sole discretion and may vary from photos, descriptions and specifications used in print and electronic advertising, information materials and third-party resources. ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

5. Drawing. On or about January 26th, 2017, ten (10) Grand Prize winners will be determined by a random drawing from all eligible entries, to be held at Storm8, Inc., 1000 Bridge Parkway, Redwood City, CA 94065 (the “Grand Prize Drawing”). Each Grand Prize winner will be notified within twenty one (21) days after his or her entry is selected, via in-app notification. To claim a prize, each potential Grand Prize winner should follow the instructions contained in his or her notification. If the potential winner’s in-app notification is undeliverable or if the potential winner does not respond within five (5) days of the first in-app notification, he/she will be disqualified, such prize will be forfeited to Provider and an alternate winner will be selected. If Provider cannot locate any prize winner pursuant to the foregoing procedure within thirty (30) days, the prize will not be awarded.

6. Disclaimer/General Release/Limitation of Liability.

(a) Provider and all other Participating Entities will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries, which may be disqualified; (b) failure to access a cellular network or Internet or send a text message or otherwise transmit anything for any period of time, regardless of telephone, electronic, hardware, software, network, Internet or other computer- or communications-related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of Provider; (d) any technical, pictorial, typographical or editorial errors or omissions in these Official Rules or any marketing materials associated with the Sweepstakes; or (e) any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.

(b) Only the prizes or their listed value above shall be awarded. By entering the Sweepstakes, you release and agree to indemnify, defend and hold harmless Provider and all its respective shareholders, directors, officers and employees, one and all, and all other Participating Entities from any liability whatsoever (including, without limitation, for damage to entrant’s or any other person or entity’s cellular or computer hardware or software or communications network, regardless of cause), and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or delivery, misdelivery, acceptance, possession, use or misuse of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

(c) Any and all claims, judgments and awards against Company arising out of or relating to this Sweepstakes shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, and never shall include consequential, incidental or punitive damages nor attorney’s fees.

7. Use of Winner’s Name, Likeness, etc. Except where prohibited by law, entry into the Sweepstakes constitutes permission to use a winner’s name, address, likeness, identifying characteristics and/or prize information for promotional purposes in perpetuity, without further permission or compensation. If selected as a winner, each entrant agrees to execute any and all documents requested by Provider to convey such rights to own all the results thereof. As a condition of being awarded any prize, except where prohibited by law, winners (1) waive the right to (a) assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, and (b) claim any liability (including attorney’s fees and costs) that might arise from using, receiving, redeeming or seeking to redeem said prize (including any travel related thereto); and (2) may be required to execute a consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. Nothing contained herein shall be deemed to obligate Provider to make use of any of the rights granted herein and each winner waives any right to inspect or approve any such use of any and every nature and kind.

8. Affidavit & Release. As a condition of being awarded any prize, each winner will be required to execute and deliver to Provider an Affidavit of Eligibility, Liability, and Publicity Release within ten (10) days of the winner being notified of his or her status as a potential winner. Failure to properly complete, sign and return the Affidavit of Eligibility, Liability, and Publicity Release, or any other documents that the Provider requires winners to fill out and execute as a condition of being awarded a prize, within such ten (10)-day timeframe may result in such prize winner forfeiting the prize and the selection of an alternate winner. All forms or other documents may be considered incomplete if they are incomplete or contain errors.

9. Winners’ List; Rules Request. For a copy of the winners list, send a stamped, self-addressed, No. 10 business-size envelope, after February 3rd, 2017 to Storm8, Inc., 1000 Bridge Parkway, Redwood City, CA 94065 Attn: BINGO JANUARY 2017 Sweepstakes Winners’ List. To obtain a copy of these Official Rules, send a stamped, self-addressed business-size envelope to Storm8, Inc. 1000 Bridge Parkway, Redwood City, CA 94065 Attn: BINGO JANUARY 2017 Sweepstakes Official Rules Request. Residents of Vermont may omit return postage.

10. Early Termination. Provider reserves the right to terminate, suspend or modify the Sweepstakes if in Provider’s sole determination it believes that the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned for any reason, including, without limitation, infection by network virus, bugs, tampering, unauthorized intervention, fraud, technical failures, force majeure or any other cause. In the case of early termination, the winner will be drawn from eligible entries received up to the time of cancellation.

11. Governing Law. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the state of California. Entrant agrees that any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prizes awarded, and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules, shall be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts sitting in San Mateo County, California. By entering the Sweepstakes, you irrevocably consent to the jurisdiction of such courts.

12. Use of Data. Provider will be collecting personal data about entrants in accordance with its privacy policy. Please review Provider’s privacy policy. By participating in the Sweepstakes, entrants hereby agree to Provider’s collection and usage of their personal information in accordance with Provider’s privacy policy and acknowledge that they have read and accepted such terms.

13. Apple. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Apple Inc. Please contact Storm8 with any questions about this Sweepstakes. Please do not direct any communications about this Sweepstakes to Apple Inc.

14. Miscellaneous. For all matters arising out of or relating to the Sweepstakes, you agree to be bound by these Official Rules and by the decisions of the Provider, which are final and binding in all respects. No entrant or winner shall have the right to contest any decision by the Provider concerning any aspect of the Sweepstakes or the interpretation of the Official Rules or the determination as to the qualification of entries. Provider reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend, modify or cancel the Sweepstakes or any entrant’s participation in the Sweepstakes if viruses, bugs, unauthorized human intervention or other causes beyond the Provider’s control affect the administration, security or proper play of the Sweepstakes or if the Provider otherwise becomes incapable of running the Sweepstakes as planned (all such decisions made by Provider in its sole discretion). Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Provider, the Sweepstakes or any other entrant (in each case as determined in the Provider’s sole discretion) are subject to disqualification from entry into the Sweepstakes. The Provider reserves the right to ban, restrict or lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes. If any provision of these Official Rules shall be deemed to violate any federal, state or local law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect.
